This long-term contract position offers the opportunity to represent individual consumers in Chapter 7 and Chapter 13 bankruptcy cases, providing comprehensive legal support from initial consultation through case resolution.
Job Responsibility
Conduct initial consultations with clients to assess bankruptcy eligibility and explain available options under Chapter 7 and Chapter 13
Develop tailored legal strategies based on clients' financial situations, including income, assets, debts, and applicable exemptions
Prepare and review bankruptcy petitions, schedules, means tests, and financial documentation to ensure accuracy and compliance with federal and local regulations
File bankruptcy petitions and manage post-filing case requirements, including resolving trustee inquiries and addressing deficiencies
Represent clients at §341 Meetings of Creditors, hearings related to motions, objections, plan confirmations, and other court proceedings
Draft and argue motions, objections, reaffirmation agreements, and plan modifications to protect client interests
Negotiate with creditors to resolve disputes, adjust payment plans, and address claims, exemptions, or delinquent payments
Communicate with trustees, creditors, and court personnel throughout the case lifecycle to ensure smooth progression
Monitor case deadlines, respond to objections, and ensure compliance with all procedural requirements
Utilize experience with Cook County filing systems to efficiently manage case documentation and filings
Requirements
Licensed attorney with active membership in the state bar
Proven experience handling Chapter 7 and Chapter 13 bankruptcy cases
Strong knowledge of civil litigation, residential real estate, and bankruptcy filing procedures
Proficiency in drafting motions, briefs, and other legal documents
Excellent negotiation skills to interact effectively with creditors and trustees
Familiarity with Cook County court systems and filing requirements
Ability to manage multiple cases simultaneously while ensuring attention to detail
Exceptional communication and client counseling skills to provide clear guidance throughout the legal process
