We're looking for a proactive and ambitious Real Estate Legal Counsel to play a pivotal part in our Legal team and Mileway Germany team. Job Responsibility

  • Lead and manage pre-litigation and litigation proceedings involving commercial real estate assets across Germany
  • Develop litigation strategies, assess claims and defences, and prepare comprehensive risk evaluations for internal stakeholders
  • Coordinate and supervise external litigation counsel in all stages of disputes, including drafting instructions, reviewing submissions, and monitoring procedural progress
  • Oversee evidence collection, document management, and preparation of court-ready materials, including affidavits, expert reports, and contractual analyses
  • Manage enforcement and debt recovery actions, including coordination with enforcement authorities, bailiffs, and notaries
  • Conduct legal due diligence on acquisitions and disposals with a focus on litigation exposure, legacy disputes, and contingent liabilities
  • Liaise with public authorities, courts, and counterparties on all matters related to contentious proceedings
  • Maintain litigation trackers, reporting structures, and internal governance documentation to ensure transparency and compliance

Requirements

  • Minimum of 5 years as a fully qualified lawyer in Germany with a proven practice focus on litigation and dispute resolution in commercial real estate
  • Extensive experience handling disputes relating to lease enforcement, property defects, service charge claims, title or boundary disputes, and contractual breaches in a real estate context
  • Demonstrated ability to independently manage complex cases before German courts, including strategy development, procedural management, and stakeholder communication
  • Strong ability to analyse litigation risk, provide strategic guidance, and shape dispute-avoidance measures for the business
  • Solid understanding of debt recovery, enforcement proceedings, insolvency-related interfaces, and the practical aspects of executing judgments
  • Excellent communication skills in German (native-level fluency preferred) and strong English proficiency
  • Proven capability to build and manage effective working relationships with external counsel, internal teams, courts, and public authorities
  • Ability to train and support internal teams on dispute-related processes, litigation strategy, and real estate–specific legal risks
