Job Responsibility:

  • Act as a vital safeguard for individuals with mental disorders, ensuring that any compulsory treatment or detention is necessary, proportionate, and respects the person's human rights
  • Manage the legal process when someone needs to be detained or treated against their will
  • Granting Consent
  • Apply to the Mental Health Tribunal for a Compulsory Treatment Order (CTO)
  • Prepare a detailed report outlining the person's social background, home life, and past wishes to ensure the Tribunal has a full picture of their life beyond their medical diagnosis
  • Act as an independent voice, often challenging medical or legal decisions to ensure the 'least restrictive' option is chosen
  • Inform patients of their right to legal representation and access to independent advocacy
  • Help patients identify and appoint a 'Named Person'
  • Investigate and provide reports for Guardianship Orders when an adult is unable to make decisions for themselves
