Job Responsibility:
Act as a vital safeguard for individuals with mental disorders, ensuring that any compulsory treatment or detention is necessary, proportionate, and respects the person's human rights
Manage the legal process when someone needs to be detained or treated against their will
Granting Consent
Apply to the Mental Health Tribunal for a Compulsory Treatment Order (CTO)
Prepare a detailed report outlining the person's social background, home life, and past wishes to ensure the Tribunal has a full picture of their life beyond their medical diagnosis
Act as an independent voice, often challenging medical or legal decisions to ensure the 'least restrictive' option is chosen
Inform patients of their right to legal representation and access to independent advocacy
Help patients identify and appoint a 'Named Person'
Investigate and provide reports for Guardianship Orders when an adult is unable to make decisions for themselves
