Responsabilités:

  • Assurer la gestion contractuelle complète des projets d’infrastructures ferroviaires depuis la phase d’appel d’offres jusqu’à la réception finale, en coordination avec les directions technique, juridique, projet et achats
  • Analyser et sécuriser les contrats (marchés publics, privés, sous-traitance, partenaires), détecter les risques contractuels, proposer et mettre en œuvre des stratégies d’atténuation
  • Participer activement à la négociation des contrats, avenants et protocoles avec les clients, fournisseurs et sous-traitants, en veillant à la conformité des engagements et à la défense des intérêts du projet
  • Être le point de contact référent pour toute question contractuelle du projet : suivi des échéances, gestion des réclamations, notifications, changements et litiges
  • Superviser la bonne application des obligations contractuelles (délais, coûts, pénalités, garanties, assurances), en lien étroit avec les équipes projet et les services supports
  • Préparer et piloter le reporting contractuel, rédiger les correspondances et notes d’analyse, alimenter les tableaux de bord contractuels, et assurer une communication adaptée avec les parties prenantes internes et externes
  • Accompagner la clôture des contrats : réception des ouvrages, mainlevées, gestion des levées de réserves, du solde financier et des garanties
  • Sensibiliser et former les équipes projet à la culture contractuelle : bonnes pratiques, risques, procédures internes et enjeux de conformité

Exigences:

  • Diplôme d’ingénieur, de juriste ou équivalent (Bac+5), idéalement complété par une spécialisation en droit des contrats, droit de la construction ou management de projet
  • Solide expérience (minimum 7 ans) en gestion contractuelle sur des projets d’infrastructures de grande envergure, idéalement dans le domaine ferroviaire, des travaux publics ou de l’ingénierie
  • Excellente maîtrise de la réglementation contractuelle française et européenne (marchés publics, CCAG, normes FIDIC, procédures claims)
  • Expérience concrète de la négociation contractuelle avec différents types de parties prenantes : clients, maîtrises d’ouvrage, consortiums, sous-traitants et prestataires internationaux
  • Capacité à anticiper et gérer les risques contractuels, à argumenter, à rédiger et à communiquer avec clarté en français et en anglais (la maîtrise d'une autre langue est un atout)
  • Rigueur, sens de l’analyse, esprit de synthèse et aptitude à travailler en mode projet avec des équipes pluridisciplinaires
  • Maîtrise des logiciels bureautiques (Pack Office, outils de gestion de projet, solutions de gestion contractuelle/documentaire)
  • Autonomie, réactivité, éthique professionnelle et capacité à gérer les priorités dans un environnement exigeant

  • Une contribution effective aux KPIs de la fonction juridique définis au niveau du Groupe
  • Suivi et gestion avec la Direction du Contentieux des éventuels litiges survenant dans le cadre de l'exécution du projet (collecte de données pertinentes relatives à l'environnement contractuel et opérationnel et preuves associées)
  • Contribution active à la mise en place des actions du programme de conformité du Groupe notamment en assistant le compliance officer de la BL dans la mise en œuvre de l'ensemble des piliers du programme (Antitrust, Anticorruption, RGPD, Trade compliance & devoir de vigilance)
  • Participation à un groupe de travail transverse à la DJC DIS/IBS (contract management, IP, contrats types…)
